Terms & Conditions for High Flyers Tarifa

Although we’re a relaxed bunch at High Flyers and want your stay to feel easy and enjoyable, we are still providing a professional service. These Terms & Conditions outline our responsibilities to you, and your responsibilities to us and to fellow guests.
By making a booking with us, you acknowledge and accept the following Terms & Conditions.
1. Booking Details
Please check your booking confirmation carefully as soon as you receive it.
If any details are incorrect, you must notify us immediately by email at:

2. Contract
Your contract with High Flyers Tarifa is formed once:
- You make a booking
- You receive a confirmation from us, and
- Full payment has been made.
By completing the payment, you agree to these Terms & Conditions.
3. Cancellation & Changes to Your Holiday
A) Cancellation BY YOU
All cancellations or changes must be made by email to:
HighFlyersTarifa@gmail.com
Cancellation charges are as follows:
Time Before Arrival Cancellation Charge
28 days or more Free
7–28 days 50% of total booking value
Less than 7 days 100% of total booking value
If you simply wish to change dates, we will always try to accommodate you where availability permits.
B) Cancellation BY US
We will always do our best to avoid cancelling your holiday.
In the unlikely event that High Flyers must cancel your stay, you will be:
- Offered alternative available dates, or
- Issued a full refund if the alternatives are not suitable.
This does not apply to circumstances outside our control (see Force Majeure below).
C) Issues Caused by THIRD PARTIES
We cannot be held responsible for:
- Airline cancellations or delays
- Issues with external activity providers
- Disruptions caused by other companies
However, we will always help you with advice and assistance if something unexpected happens.
D) Force Majeure
High Flyers Tarifa cannot accept liability or offer refunds or compensation for any event beyond our reasonable control, including but not limited to:
- War, threat of war, or civil unrest
- Terrorist activity
- Government actions or travel restrictions
- Strikes or industrial disputes
- Natural disasters
- Fire, severe weather conditions, flood
- Public utility failures (water, electricity)
- Epidemics, pandemics, or health emergencies
Force Majeure events do not constitute grounds for refunds where services cannot be safely or reasonably provided.
4. Limitation of Liability
High Flyers Tarifa will not be held responsible for:
- Loss, damage, injury, or inconvenience arising from events outside our control
- Loss or theft of personal belongings
- Injuries resulting from sports or outdoor activities
- Disruption caused by neighbouring properties or works
- Failure of public services (water, electricity, internet)
Nothing in these Terms limits your statutory rights under EU or Spanish law.
5. Insurance
It is your responsibility to hold appropriate travel insurance for your stay, including coverage for kitesurfing or other adventure sports if you intend to participate in them.
We strongly recommend comprehensive cover for medical expenses, cancellations, and personal property.
6. Guest Responsibilities
We want all guests to enjoy their stay.
High Flyers reserves the right to refuse service or require a guest to leave if their behaviour:
- Is disruptive
- Causes damage or risk to others
- Interferes with the enjoyment of fellow guests
- Violates Spanish law
In such cases:
- No refunds will be issued
- Any additional costs incurred are the responsibility of the guest
You are also responsible for any damage caused to the property.
7. Kitesurfing Lessons & Third-Party Providers
Beginner lessons and some activities are provided by our trusted partner KBC Tarifa (Kiteboarding Club Tarifa).
- You will be required to sign their disclaimer and agree to their safety rules.
- Any issues, complaints, or claims relating specifically to instruction, equipment, or safety must be addressed directly with KBC Tarifa, as they are the service provider and responsible for the activity.
We only facilitate introductions and are not liable for services delivered by third-party providers.
8. Governing Law
These Terms & Conditions are governed by Spanish law.
Any disputes will fall under the jurisdiction of the courts of Cádiz province.
